COMMITTAL ORDER
Accused No.1, 3 and 4 are present. They are on Bail. Advocate for
accused No. 1 to 5 is present. Accused No.6 ,7 and 8 are in jail, their
advocate is present. All the accused are charged with the offence punishable
under sections U/Sec. 307, 326, ,34, 143, 144, 142, 148, 149 of IPC r.w.
Section 37 r.w. 135 of Maharashtra Police Act. The offence punishable
under section 307 of Indian Penal Code is exclusively triable by the Hon'ble
Court of Sessions. The copies of police report and other documents as
specified in section 207 of the Code of Criminal Procedure have been supplied
to the accused. The accused are represented by Lawyer. The Ld. Advocates of
the accused are intimated about committal of the case to the Hon'ble Court of
Sessions. The case will have to be committed to the Hon'ble Court of Sessions
in view of nature of offence. Hence, the following order :-
ORDER
1. The case is hereby committed to the Hon'ble Court of Sessions.
2. Accused No.6,7 and 8 are remanded to Magisterial Custody until

commitment of the case and also during and until the conclusion of trial before
the Hon'ble Court of Session vide section 209 (a) (b) of the Code of Criminal
Procedure.
3. The Jail Authorities is directed to produce the accused No.6,7 and 8
before the Hon'ble Court of Session on 03/02/2023 on receiving production
warrants from that Court in Form No. IV, Chapter XXXIII of the Criminal
Manual.
4. The accused No.1 to 5 are directed to appear before the Hon'ble Court of
Sessions on 03.02.2023.
5. The record of the case, the documents and articles, which are to be
produced in evidence, shall be sent to the Hon'ble Court of Sessions.
6. The Police Station Officer, Police Station Khar is directed to produce
muddemal property, in the Hon'ble Court of Session on or before 03.02.2023.
7. The Public Prosecutor shall be notified of the commitment of the case to
the Hon'ble Court of Sessions.
