COMMON ORDER BELOW EXH.1
(In C. C. No. 860 PW 2008 and C. C. No. 1552 PW 2008)
1. Today accused are present before court through their advocates. It
is brought to notice of Ld. Advocate Shri. A. A. Nalawade, for accused
persons in both the matters that charge sheet is not filed, against one of
the main accused.
2. It is also noticed by this court as well as accused persons that
matter is now time bound and needs to be expedited. Ld. Advocate for the
accused persons submitted that he will produce the accused, who is
shown as absconded accused in the charge sheet and in the mean time
comply all the legal requirements and sought some substantial time.
Therefore, he sought adjournment.
3. It is noticed that if such a permission is not granted there is no point
in proceeding with the matter and technically comply the directions,
which will frustrate the very purpose of the directions. Therefore, time
needs to be granted to the Ld. Advocate. Accordingly, following order -
ORDER
Matter is adjourned upto 07.10.2023. In the mean time the Ld.
Advocate for the absconded accused shall do the necessary legal
formalities as mentioned by him. He shall also obtain necessary orders
from the High Court, due to the peculiar situation arrived, about extension
of time. Copy of this order shall be kept in both the matters.
