ORDER BELOW EXH. 1
1) Applicant viz. Jennifer D Souza praying for direction to
respondent to register her birth. She submitted that, on 17/02/1960 she
Jennifer D Souza born at Flat No.G/1, Ground Floor, Rose Monica
Co.Op. HSG, Soc., Kalina Village, Church Road, Santacruz (E) Mumbai-
400029. However, entry regarding her birth was not taken with the
office of respondent. She requires birth certificate of her. Hence, this
application is filed. Applicant in support of her contention has filed her
Aadhar Card, her School Leaving Certificate, her PAN Card, her Baptism
Certificate and Aadhar Card of Michael Robert D’Souza and his affidavit
as a witness. Application is well supported by affidavit of applicant.
2 Respondent did not dispute that on dated 17/02/1960 the
the applicant Jennifer D Souza was born and the entry thereto was not
taken in the concerned register. Considering the documents filed by the
applicant it appears that, the date of the birth of applicant is correctly
mentioned. Admittedly, after the birth of applicant the entry thereto was
not taken in the concerned register even after laps of more than 03
years. Therefore, the Respondent needs to be directed to take entry
regarding birth of applicant Jennifer D Souza in the concerned register.
Hence, the following order is passed.
O R D E R
1. Application is allowed.
2. On payment of requisite charges respondent is directed to
take entry regarding the date of birth of applicant viz.
Jennifer D Souza, as on 17/02/1960 in the concerned
register.
