The complainant and his advocate absent. Matter is of year
2021. Mediation failed. No steps taken to secure presence of accused
by the complainant despite passing specific order on 02.04.2025.
Keeping the file pending years together without proceeding further,
taking appropriate steps by the complainant is unjustified.
2. Considering the year of the case there is reason to believe that
complainant might have lost interest in proceeding with the case.
Hence, I pass following order.
ORDER
1. Complaint is dismissed in default of the complainant vide
section 256 of Cr.P.C.
2. Accused is acquitted of the offence punishable under section
138 of Negotiable Instrument Act.
3. Order dictated and pronounced in open court.
