ORDER
1. The applicant is praying for return of gold chain weighing
05.00 grams, seized by Vakola Police station in C.R.No. 520/2021
registered u/sec. 392, 34 of the IPC.
2. The I.O. submitted that piece of gold chain weighing 5.00
grams has been seized. He has given no objection to hand over gold chain
to the applicant.
3. The applicant submitted that her gold chain was robbed. She
lodged report about robbery. She produced on record copy of FIR, bill and
Aadhar in support of her version. The IO stated that the application has
identified piece of seized gold chain. The applicant has also produced
Affidavit stating that piece of gold chain belongs to her. She produced
photographs of gold chain. No one else except the applicant has claimed
the custody of gold chain. There is no likelihood that the trial will
commence soon and conclude in near future. It will not be proper to keep
such valuable at the property room in the police station. Hence, the gold
chain may be handed over to the applicant by imposing conditions. In the
result, following order is passed.
ORDER
1. The application is allowed.
2. Seized piece of gold chain weighing 05.00 grams, seized
by Vakola Police station in C.R.No. 520/2021 registered u/sec. 392,
34 of the IPC be given to the applicant.
3. The applicant is directed to furnish indemnity bond of
Rs.20,000/.

4. The applicant is directed not to sell, transfer, alter,
dispose or hand over the seized ornament to third person without
prior permission of court and to produce the concerned ornament
before the Court, whenever required for trial.
5. The Investigating Officer is directed to produce the
indemnity bond with the final report.
