ORDER BELOW APPLICATION FOR PERMISSION TO TRAVEL ABROAD
1] This is an application filed by applicant/accused Mrs. Sonielle
Jadhav who is one of the accused in C.C. No.715/PW/2012 registered by
Bandra Police Station.
2] It is stated that the applicant wants to travel abroad to South
Africa to meet her husband for the period from 01/05/2018 to 01/06/2018.
3] On the application, say of Ld. APP was called. Ld. APP filed her say
and submitted that in the application neither the stage of case and offence is
mentioned. There is delay in case. If the application is granted there is
likelihood accused may abscond. Hence, opposed the application.
4] Heard Ld. APP and advocate for applicant. Perused the
application, say filed by Ld. A.P.P. and documents annexed with the
application. I do not find that the progress of the case would hamper, during
that span of time if the accused is granted permission to go abroad subject to
some condition that she would not dispute her identity as a particular accused
in the case and that an Advocate on her behalf would remain present in the
Court. Hence, the following order.
ORDER
i] The application is allowed.
ii] Permission is granted to the applicant/accused Mrs. Sonielle
Jadhav to travel abroad to South Africa for the period from
01/05/2018 to 01/06/2018 with condition that she shall not

misuse the said permission obtained by her.
iii] As a condition precedent, she shall furnish undertaking in
writing that she shall remain present if required by this court to
appear before it at any time during the continuance in force of
the Passport so issued by Passport Authority.
iv] The applicant is directed to deposit cash of Rs.10,000/ (Rupees
Ten Thousands only) against security for the same, and she can
withdraw it after her arrival.
v] The applicant report his arrival in India to the court after
01/06/2018.
