ORDER BELOW BAIL APPLICATION NO. 2006/2022
1. Perused record. Heard both the sides.
2. This is an application under Section 437 of Code of Criminal
Procedure for bail. The accused prayed for bail mainly on the ground that
he is innocent and falsely implicated in this matter. No offence made out
against the applicant/accused, as the incidence is of civil nature. Even
accused had issued two cheques to informant. The charge sheet reflects
that nothing recovered from him and no evidence found against accused
even after completion of investigation. Ld. A.P.P. objected to it stating
that though investigation is over, there is possibility of tampering.
Allegations are serious. Therefore, application shall be rejected.
3. It is alleged that present accused along with other accused persons
lured informant and obtained from her Rs.15 lacs under the pretext of
providing rented house to her in the form of heavy deposit, in respect of
house in which other accused Mr. Afsar Ali was residing. Accused is in
custody since long. Investigation already over and charge sheet also filed.
4. There is doubt about the nature of the offence as substantial
allegations constitutes civil liability. Accused is residence of Mumbai and
he is ready to cooperate with trial and remain abide by the conditions, if
any, imposed. Offence is triable by this Court itself. Other accused
already on bail. The conclusion of trial will take much time. Pretrial
detention not warranted in this matter. Considering all these aspects and
facts and circumstances and reasons assigned in the bail application
following order -
ORDER
a. Application is allowed.
b. Accused is released on bail on his furnishing P.B. and S.B. of
Rs.15,000/-. Permission granted to deposit cash surety instead of surety
bond.

c. Accused person shall furnish his detail address and proof thereof.
