Today matter is taken up before this court in Special Drive for petty
cases. Present matter is old. It is filed for an offence punishable under
Section 7(2) r/w.20 of the Cigarettes and Other Tobacco Products
(Prohibition of Advertisement and Regulation of Trade and Commerce,
Production, Supply and Distribution) Act, 2003. Accused continuous
absent. Allegations are vague. Further, the basic requirement to prove the
charge i.e. the report of chemical analyzer is not on record. The whole
final report, even if accepted as it is, no conviction warranted. There is no
point to keep the matter pending. Therefore, following order :
ORDER
A. The proceeding stopped under Section 258 of Code of Criminal
Procedure and accused discharged.
B. Cash surety, if any, deposited shall be refund to the accused, if
claimed within one year from today.
C. After one year the cash surety amount be forfeited to the
Government. Liberty granted to the accused to claim it even after
one year also, by applying to that effect.
