ORDER BELOW EXH.01
Heard advocate for complainant, accused No.3 Dipesh
Lakshman Bhagtani and his advocate. Perused proceeding.
2. Two separate proceedings are pending against accused No.3,
his father accused No.2 Lakshman Bhagtani, accused No.4 brother
Mukesh Lakshman Bhagtani, accused No.5 mother Mrs. Maya
Lakshman Bhagtani accused No.5, since year 2018. Already
proclamation warrants are issued against all the accused except
accused Dipesh Lakshman Bhagtani in both cases. The report shows
that accused Mr. Lakshman Bhagtani, his son Mukesh Lakshman
Bhagtani and wife Maya Lakshman Bhagtani are absconding. According
to the submission made on behalf of accused No.3 Dipesh Bhagtani, all
these accused went to Dubai and not in his contact since last 8 years.
According to the complainant all the properties of accused are attached
by various financial institutions and available for attachment.
3. There is reason to believe that all accused are in close
relations with each other. Accused No.3 seems hiding the correct
addresses of rest of the accused in order to avoid their presence for
trial. Accused No.3 being co-parcerner, co-member of family of
Lakshman Bhagtani, it will be just and proper to give an opportunity to
accused No.3 to convey their correct addresses before adopting drastic
steps for securing presence of rest of the accused. It is in the interest of
accused Dipesh Bhagtani as well as complainant to go with the trial on
merits. Hence, I pass following order.

ORDER
1. Accused Dipesh Lakshman Bhagtani is directed to provide
correct address of his father, mother and brother within 20
days from today, failing which this court will constrain to pass
necessary orders may be going to the extent of cancellation of
Passport and issuing warrant through Embassy etc.
2. Order dictated and pronounced in open court.
3. Order be uploaded on Court Web Portal.
