Khajotia for the accused :
23. It is true to say that I have not produced the cheque
deposit slips whereby I presented the cheques for encashment. It is true
to say that I have not filed the memo of initial cheque for an amount of
Rs.78,50,000/. It is true to say that I have not produced the cheque
dishonour of memo of Bharat Bank.
24. I have filed income tax returns for the year 2015, 2016
and 2017. I have not shown any income out of agricultural property. I
have no income from agricultural property. It is not true to say that I do
not have any agricultural certificate. In the year 2017 I was not having
any agricultural land in my own name. After death of my father my
name is recorded in the Revenue record by inheritance. It is true to say
that in the year 20162017 I was not possessing any agricultural
certificate in my own name. I have not obtained permission of Collector
to build hospital before entering into MOU. It is true to say that after
28.03.2016 there is no MOU executed in between me and accused. It is
true to say that MOU Exh.11 now shown to me is not registered with
the Sub Registrar. It is true to say that the same is not notarized. I do
not know the name of the witness of MOU Exh.11. It is not true to say
that on 28.03.2016 I had not issued any cheque to the accused. It is
true to say that in MOU Exh.11 it is nowhere mentioned that I issued
cheque to the accused. It is true to say that in MOU Exh.11 it is
nowhere mentioned that accused is owner of 2 acre land. It is true to
say that in the MOU Exh.11 it is not mentioned who is the owner of 2
acre land. It is true to say that the MOU was valid only for three
months. It is true to say that I have not produced any document related
to extension of MOU for further period upto 28.08.2017.
