ORDER BELOW EXH. 1
1) Applicant viz. Akhlaque Ahmed has filed application for
registration of death of his father namely Anwar Uddin Sahadat Ali
Shaikh, as per section 13 (3) of Maharashtra Registration of Births and
Deaths Act, 1969. According to him his father namely Anwar Uddin
Sahadat Ali Shaikh died on 06/11/2018, at his home i.e. at Room No.
702, building No. 17/B, Motilal Nehru Nagar, Bandra (E), Mumbai. But
the entry of his death is not taken in the death register maintained by
the Sub-Registrar of Birth and Deaths. Lastly, he prayed that, application
be allowed.
2) Applicant in support of his contention has filed on record
copy of Aadhar Card, Ration Card, Copy of Medical Certificate of cause
of death, etc.
3) The notice to respondent came to be issued and reply to the
said notice the respondent has filed on record verification of death of
deceased Anwar Uddin Sahadat Ali Shaikh. I gone through the said
report (Exh.-8). It reveals that, the deceased Anwar Uddin Sahadat Ali
Shaikh, died on 06/11/2018, at his home in Room No. 702, building
No. 17/B, Motilal Nehru Nagar, Bandra (E), Mumbai and entry of death
of deceased Anwaruddin Sahadat Ali Shaikh has not been registered in
death record.
4) Respondent did not dispute that on dated 06/11/2018 the
the deceased Anwar Uddin Sahadat Ali Shaikh died and the entry
thereto was not taken in the concerned register. Considering the
documents filed by the applicant, it appears that, the date of the death
of applicant’s father is registered. Admittedly, after the death of
applicant’s father the entry thereto was not taken in the concerned
register even after laps of more than 06 years. Therefore, in view of
provision of sub section 3 of section 13 of Maharashtra Registration of

Births and Deaths Act, 1969 the Respondent needs to be directed to
take entry regarding death of applicant’s father Anwar Uddin Sahadat
Ali Shaikh in the concerned register. Hence, the following order is
passed.
O R D E R
1. Application is allowed.
2. On payment of requisite charges respondent is directed to
take entry regarding the date of death of Anwar Uddin
Sahadat Ali Shaikh, as on 06/11/2018 in the concerned
register.
