1. Perused record. Today the matter is taken before this Court in Special
Drive for disposal of petty cases. The present prosecution is lodged in
respect of an offence punishable under Section 12(a) of Maharashtra
Prevention of Gambling Act.
2. The matter is old. Accused continuous absent. Despite issuance of
repeated warrants, accused not turned up. The allegations are vague.
Conviction not warranted, even if those allegations accepted as they are,
therefore, following order :
ORDER
A. The proceeding stopped under Section 258 of Code of Criminal
Procedure and accused discharged.
B. The articles seized shall be disposed off and cash seized shall
be forfeited to the Government.
C. Cash surety, if any, deposited shall also stands forfeited to the
Government after appeal period.
