ORDER BELOW BAIL APPLICATION
1. Perused record. Heard both the sides.
2. The present application is filed by accused Mr. Bijendra Nathuram
Gothwal, after filing of charge sheet, for bail, under Section 480 of Bhartiya
Nagarik Suraksha Sanhita (B.N.S.S.), after rejection of his first bail
application, before filing of charge sheet. The summary of the grounds for
bail is that he is innocent. Investigation is over and charge sheet already
filed. The whole evidence already collected. He is ready to remain abide by
the conditions. Other accused already released on bail, etc.
3. Ld. A.P.P. objected to it stating that the active role of the accused
transpired during investigation. The offence is serious, there is possibility
of absconding, etc.
4. As observed in previous bail order, the summary of the first
information report, is that some unknown persons approached informant for
investment. Lured by offers made the informant invested an amount of
about Rs.20,83,656/-. Then he came to know that he has been defrauded by
those unknown persons.
5. During investigation it is transpired that the present accused arranged
for bank accounts of several other persons for siphoning off the money
obtained from informant fraudulently. No doubt some evidence found
connecting the accused with the allegations. But now investigation is over
and charge sheet already filed. Accused is ready to remain abide by the
conditions. Offence is triable by this court itself. Other accused already
released on bail. Therefore, bail prayer needs to be allowed in view of these
aspects of the matter and reasons assigned in the bail application.
Accordingly, following order -

b. Accused Mr. Bijendra Nathuram Gothawal, is released on bail on his
furnishing P.B. and S.B. of Rs.15,000/- and on deposing an amount of
Rs.50,000/- (Rs. Fifty Thousand only), in this court.
c. Permission granted to deposit cash security instead of surety bond.
d. Accused shall furnish his detail address and proofs thereof.
e. The informant is at liberty to withdrawn the amount of Rs.50,000/-
(Rs. Fifty Thousand only), if deposited by the applicant.
