ORDER BELOW EXH.1
1. This is an application under Section 457 of Code of Criminal
Procedure for release of property.
2. As per applicant it was duped by unknown persons and they
fraudulently obtained from it the amount of Rs.35,60,830/-. At the
instance of applicant, the offence was registered with respondent Police
Station at C.R. No.134/2023. During investigation the bank accounts
mentioned in the present application was frozen by the respondent as the
part of the amount deposited by the applicant is lying in it.
3. Initially the order was passed and the concerned bank was
directed to transfer the amount to the applicant. However, during
pendency of this application substantial amount has been already
transferred to some other person and now applicant filed this application
seeking the direction to transfer the remaining amount of Rs.17,90,909/-
in it’s account as bank sought amended order along with required
modifications. Therefore, following order -
ORDER
a. The application is allowed.
b. The Nodal Officer of bank/branch, Canara Bank, Branch Noida
Morna, having IFSC Code CNRB0018778, is directed to transfer the
amount of Rs.17,90,909/- lying in the account No.87782010152378, in an
account of applicant India Coke and Power Private Limited, bearing
Account No.693011004304, maintained with Kotak Mahindra Bank,
Branch Marol, Saki Vihar Road, Mumbai, having its IFSC Code
KKBK0001364, immediately.
c. The concerned Investigating Officer shall also brought the
above order to the notice of concerned bank and request them to transfer
the amount lying in above account, in an account maintained by the

applicant mentioned in the application, after executing indemnity bond of
Rs.18,00,000/- (Rupees Eighteen Lacs only) before respondent.
