Perused complaint, documents on record. Heard
complainant at length. Except the agreement to conduct the business
of hotel named M/s. Kashid Tents Resort, 233, Sea Point Villa,
Chikni, Kashid, Raigad, Maharashtra, nothing happened within the
jurisdiction of this court. Execution of an agreement to do a lawful
business it itself not an offence. The alleged offence if any is
committed in breach of the agreement. The business is exclusively
conducted within the jurisdiction of Kashid, Raigad and alleged
offence of cheating, misappropriation and destruction or damage to
property etc. is allegedly taken place within the jurisdiction of Kashid,
Raigad only. This court has no jurisdiction to take cognizance. Thus,
the complaint is returned to the complainant for filing the same
before appropriate court vide section 201 of Cr.P.C. for filing the
same with the proper court.
