ORDER BELOW BAIL APPLICATION NO.1948/2022
1. Perused record. Perused say filed by Ld. A.P.P. Heard Ld. Advocate
for the applicant/accused. Since first session Ld. A.P.P. was repeatedly
called, but nobody appeared on behalf of prosecution. Even special
messenger sent to Ld. A.P.P. to appear and argue the matter, but ignoring
the request Ld. A.P.P. not appeared. It seems that she is no more interested
in making her submissions. Accused is in custody since long. Ld.
Advocate for the accused pressed this application and requested to
proceed without hearing of prosecution, therefore, without hearing oral
arguments relying on the say filed by Ld. A.P.P. the matter was proceeded
further.
2. It is submitted that accused is innocent and falsely implicated in the
matter. Investigation is over and charge sheet already filed. Offences are
triable by this court and punishable only upto three years, besides other
grounds. Application is objected mainly on the grounds that involvement
of the accused noticed in the incidence. Accusation are well founded.
There is possibility of tampering and absconding of accused. Therefore,
application shall be rejected.
3. Accused is in custody since 01.04.2022. Investigation is over and
charge sheet is filed. Offence is triable by this court itself. Accused is
ready to remain abide by the conditions, if any, imposed. Other accused
are already on bail. The trial and its conclusion will take much time. The
pre-trial detention is not warranted. Considering nature of offence,
reasons assigned and other facts and circumstances, following order.
ORDER
a. Application is allowed.
b. Accused is released on bail on his furnishing P.B. and S.B. of
Rs.25,000/-. One or two sureties or cash security in substitution of surety
bond allowed.

c. Accused person shall furnish his detail address and proof thereof.
