COMMITTAL ORDER
This chargesheet is submitted against the accused before this Court
by Sr. Inspector of police, Santacruz Police Station, Mumbai for the offence
punishable U/Sec. 353, 332 r/w. Sec. 34 of the Indian Penal Code. Copy of
chargesheet is already furnished to the accused.
The main offence punishable U/sec. 332 & 353 of IPC alleged
against accused exclusively triable by the Hon'ble Court of Sessions. In
view of decision of Hon'ble High Court in Shyamrao Pillare V/s State of
Maharashtra in Cri. Application 1146/2018 the cases under the said
provision are required to be committed to Hon'ble Sessions Court. Hence,
this case is committed to the Court of Sessions, Gr. Bombay, U/Sec.209 of
the Criminal Procedure Code.
The accused are on bail. They are directed to appear before Court
of Sessions, Gr. Bombay on 17.11.2021.
The record and proceeding be sent to the Court of Sessions, Gr.

Bombay forthwith. The Santacruz police station is hereby directed to
produce the muddemal property, if any, before the Court of Sessions, Gr.
Bombay as and when directed.
The Public Prosecutor, Court of Sessions, Gr. Bombay, be intimated
accordingly.
