ORDER PASSED BELOW EXH.-1
Accused No.2, Amir Ahmed Mohd. Raees Ahmed Idrisi, is present before
this court. The Accused No.1, Mohd. Yasir Mohd. Raees Ahmed Idrisi, Accused
No.3, Rashid Rajimullah Shaikh, Accused No.4, Riyaz Ahmed Maqsood Ali
Shaikh, and Accused No.5, Mohd. Rizwan Mohd. Suleman Shaikh, appeared
before this court through video conferencing. They are charged with the offence
punishable under Sections 307, 326, etc. of the Indian Penal Code, out of which
the principal offence is exclusively triable by the Court of Session. Heard Ld.
Advocate Shri. Prablin Sing Abrol, appearing for all the accused persons. He
requested to commit the matter for trial to Session Court. He undertook to appear
on behalf of all the accused persons before Sessions Court after committal by
filing the vakalatnama, on behalf of all the accused persons at relevant date. He
admitted the compliance of Section 207 of Code of Criminal Procedure, which is
already done. As a rider, it is directed that such copies of charge-sheet and other
police papers shall also be sent to accused persons through jail authorities. Thus,
there appears no hindrance in committing the matter as all the technicalities
already complied. Hence, following order :
ORDER
a. The case be committed to the Court of Session.
b. Accused No.2, Amir Ahmed Mohd. Raees Ahmed Idrisi, is directed to
appear before the Court of Session on 12.10.2021.
c. The Accused No.1, Mohd. Yasir Mohd. Raees Ahmed Idrisi, Accused No.3,
Rashid Rajimullah Shaikh, Accused No.4, Riyaz Ahmed Maqsood Ali Shaikh, and
Accused No.5, Mohd. Rizwan Mohd. Suleman Shaikh, are remanded to
Magisterial Custody until commitment of the case and also during and until the
conclusion of trial before the Court of Session vide Section 209 (a) and (b) of the
Code of Criminal Procedure.
d. The Jail Authorities are directed to produce the Accused No.1, Mohd. Yasir
Mohd. Raees Ahmed Idrisi, Accused No.3, Rashid Rajimullah Shaikh, Accused
No.4, Riyaz Ahmed Maqsood Ali Shaikh, and Accused No.5, Mohd. Rizwan
Mohd. Suleman Shaikh, in custody before the Court of Session on receiving

production warrant from that Court in Form No.IV, Chapter XXXIII of the
Criminal Manual or on or before 12.10.2021, if such warrant not received.
e. The record of the case, the documents and articles, which are to be
produced in evidence, shall be sent to the Court of Session.
f. The Police Station Officer, Dharavi, Mumbai, be directed to produce
muddemal property in the Court of Session on or before 12.10.2021, positively.
g. The Public Prosecutor shall be notified of the commitment of the case to
the Court of Session.
