ORDER PASSED BELOW EXH.1 This application is filed by the applicant namely Rajan Bapu Loke for release of autorickshaw bearing No.MH03DC0744, which is seized by the Excise Department in connection with Crime No.111/2020 registered with the Excise Department for the offence punishable under section 65(A), (E) of Bombay Prohibition Act. 2) Say was called from I. O. and A.P.P. They both have strong objection and submitted that it is used for transportation of liquor and it is essential at the time of trial. They both prayed for rejection. 3) In support of his contention regarding ownership, applicant has filed on record true copies of RC book, permit, reminder loan papers and verified copies of driving licence alongwith his affidavit. The applicant is directed to produce fitness certificate of said autorickshaw from 04.12.2021. But till today, the applicant miserably failed to comply the -- 1 of 2 -- 2 order. The applicant failed to file verified copy of fitness certificate of auto rickshaw. Therefore, he is not entitled to get the custody of the vehicle.
