ORDER BELOW EXHIBIT 01 IN C.C. NO. 407/N/2026

1. This is an application filed by applicant Kailash Govindram
Purohit for return of property i.e. cash of Rs.2,16,000/-.
2. Perused the application and say of I.O. and Ld. A.P.P.. By the
instant application the amount of Rs.2,16,000/- claimed by the applicant
which has been recovered during the course of investigation by Mahim
Police Station.
3. Ld.A.P.P. and Investigation Officer has submitted for passing
appropriate orders for return of the said amount to the applicant on terms
and condition. It is clear from record that amount of 2,16,000/- is
recovered by I.O. during investigation. It prima facie proves that the
applicant is owner of the seized cash amount and if the said cash is not
returned to the applicant, it will lie redundant. No purpose will be
served by keeping it in the police station. The same is liable to be
returned to the applicant subject to certain conditions. Hence, order.
O R D E R
1. Application is allowed.
2. Police Station, Mahim is hereby directed to release the
amount of Rs.2,16,000/- (Rs. Two Lakhs Sixteen Thousand Only ) to the
applicant on executing Supartnama of Rs.2,00,000/- (Rs. Two Lakhs
only).

3. The applicant is directed to re-deposit the said amount as
and when required by the Court.
Issue Humdast accordingly.
