ORDER BELOW APPLICATION FOR RETURN OF PROPERTY IN
C.C.NO.367/N/2022 OF BKC POLICE STATION.
1. The applicant/ accused Toni Sebastian filed this application
for return of passport bearing no. J3111437 seized by BKC Police
station in C.C.No. 178/PW/2019 registered u/sec. 420, 465, 467, 468,
471, 120B of IPC.
2. Respondent and APP opposed the application.
3. Admittedly the seized passport is not used for the
commission of the alleged offence. The seized passport is not the
offending documents. IO has not applied to the passport authority for
taking any action. Seized document is not required for the purpose of
trial. Keeping the seized document in custody of the police station for
further period is not necessary. Thus, it will be proper to return the
same to the applicant/ accused. Applicant/ accused is ready to abide by
the conditions that may be imposed on him. In the result, following
order is passed:
ORDER
1. The application is allowed.
2. The custody of passport bearing no. J3111437 seized by BKC
Police station in C.C.No. 178/PW/2019 registered u/sec. 420,
465, 467, 468, 471, 120B of IPC be handed over to the applicant.
3. The applicant is directed to produce the said document as and
when required by this court.
4. The applicant should obtain prior permission of this court before
traveling abroad.

5. The copy of the said order be kept with case.
