ORDER BELOW EXH.1 IN C.C.NO. 1946/PS/2016

This case in pending since 2016, the accused is
absconded. The offence is punishable under 65(e) of Bombay
Prohibition Act, 1949. Muddemal property i.e. 12 x 180 ml. Bagpiper
Whiskey worth Rs.1260/- was recovered. No purpose found to keep
pending proceeding. Therefore, it is just and proper to stop
proceeding vide section 258 of Cr.P.C. Hence, following order is
passed.
ORDER
1. The proceeding is stopped vide section 258 of Cr. P.C.
2. The accused stands discharged.
3. Muddemal property be disposed of as per law.

The informant and accused have filed joint application
seeking permission to compound the offence punishable under
section 406 of IPC. Complainant has been identified by Ld. APP, as
she appeared in consequence to the witness summons. Her identity
card is attached with the application. The offence punishable under
section 406 of IPC is compoundable with permission of the court.
The informant & accused have settled dispute outside court and does
not wish to proceed with the case. In view of this, age of accused and
nature of offence, permission is granted. Order followed Exh-1.
