Order Details: Order Below EX 1 Pdf Text: 1 ORDER BELOW EXH.1 IN C.C.NO. 1941/PS/2016 Perused the record. It appears that the chargesheet is filed u/sec.65(e) of the Bombay Prohibition Act. The record further shows that till today, police machinery miserably failed to execute NBW on accused. Sufficient and considerable opportunity as well as time is given to police machinery. Case is 5 years old. Hence, in such situation, no purpose will be served by keeping it pending. Therefore, in such facts & circumstances, the proceeding of the case is stopped u/sec.258 of the Code of Criminal Procedure. The accused is acquitted and his bail bonds, if any be canceled. The seized whiskey be forwarded to Excise Department and seized Hyundai Gitz car bearing No. MH43R7117 be returned to the original owner after due verification and after the appeal period is over.
