ORDER BELOW EXH.-1
1. Perused the record. Heard Ld. Advocate Shri. Akshay Sonawane, for
the applicant.
2. Nobody present on behalf of respondent. No say filed.
3. The present application is filed, for correction of date of birth, in the
passport issued by respondent, as 10.11.1964, instead of 01.01.1963. It is the
case of the applicant that she is holding Indian Passport since long. Due to
oversight the said mistake in date of birth occurred, in the passport, issued
from time to time. She wants to rectify this wrong entry, but concerned
authority is seeking directions from this court. If it is allowed to be continued,
it is creating problems in relevant proceedings and other aspects before
various authorities based on passport entries.
4. Heard Ld. Advocate for the applicant, in addition to contents of the
application and affidavit filed in its support, applicant relied on various other
documents, such as copy of leaving certificate, birth certificate, PAN card and
Aadhar card. He also relied on circular issued by Ministry of External Affairs,
India, bearing No. VI/401/2/5/2001, dated 26.11.2015, by way of which certain
guidelines were issued to Passport Issuing Authorities while considering the
applications for change/correction of dates of birth entries in the passports.
5. The correction of mistake sought to be rectified, is occurred on account
of inadvertence. The period sought to be rectified is not much high, it is less
than two years. During inquiry it is noticed that the error occurred is causing
hindrances in various affairs connected with or based on the passport. The Ld.
A.P.P. also has not seriously objected to the application. He fairly submitted
that he has no objection to pass necessary orders in the interest of justice.
There came on record nothing to discard the prayer of the applicant.
Therefore, following order :

ORDER
a. Application is allowed.
b. The concerned passport authority is directed to renew the passport and
while issuing such a renewed passport, correct the date of birth of applicant as
10.11.1964, in place of 01.01.1963.
c. The passport authority shall act on certified copy of this order.
