ORDER BELOW EXH.1
1. On 03.08.2021, the accused no.1 appeared before this court through
video conferencing. The accused pleaded guilty to the offence.
2. He is totally make aware of the consequences of the pleading guilty
to the offence. Despite that he is ready to plead guilty. His plea is
voluntary.
3. The accused has caused hurt as informant failed to pay Rs.20/-,
demanded by the accused and he thus attempted robbery. Heard him on
the point of sentence. He is in jail since the month of September, 2020.
He prayed for leniency. Considering the nature of offence, the facts
transpired in it, the property involved and the period undergone by the
accused, following order :
ORDER
A. Accused no.1 is convicted under Section 241 of the Code of
Criminal Procedure, for an offence punishable under Section 394 of
Indian Penal Code and sentenced to suffer simple imprisonment for six
months.
B. He is entitled to set off as per Section 428 of the Code of Criminal
Procedure. As he is in jail since 24.09.2020, the punishment has already
been undergone by him, therefore, he shall be released forthwith if not
required in any other offence.
C. Copy of this order to be given free of cost to the accused.
D. Matter is disposed off.
