ORDER BELOW APPLICATION EXH.22
This is an application for recalling complainant on the ground
that some questions remained to be asked in cross examination.
2. Complainant objected the application vide detailed reply Exh.23.
3. Heard advocate Anil More for the accused and advocate Vikas
Kharat for the complainant.
4. Record shows that accused was given more than sufficient
opportunity to exercise right of cross examination. Accordingly,
advocate for the accused had conducted thorough cross examination of
complainant. Perusal of application shows vague reasons meeting out
necessity of recalling witness. Recalling of witness appears not
necessary for the just decision of the case which is statutory mandate
while exercising powers under section 311 of Code of Criminal
Procedure. It is not that accused was not given full opportunity. There
is no legal substance and merits in the application. Hence, I pass
following order.
ORDER
1. Application is rejected.
2. Order dictated and pronounced in open court.
3. Order be uploaded on Court Web Portal.
