I solemnly affirm on oath that -
My name is Shridhar Bhanudas Vidyadhar
Age : 66 years,
Occupation : Ex- Sweaper in BMC. Now retired.
R/o. Ghansoli, Navi Mumbai.
Examination-in-Chief of CW-02 by advocate Mr. Vikash Kharat for the
complainant :
1. I know complainant Eknath Bansode and accused Ramesh Yadav. I
was serving in BMC. I am aware about the transaction in between
complainant and accused. I can narrate when the transaction took place.
The transaction was done in my presence before me. On 31.03.2022
complainant gave Rs.5 lakhs to accused. He again paid Rs.1 lakh to
accused on 02.06.2022. Entire amount of Rs.6 lakhs was given in cash to
accused before me in my presence. The amount is paid as a hand loan on
request of accused who wanted to purchase home. The cousin of accused
used to come to him and as such I know all of them. Accused has not
repaid the amount to the complainant. Accused had agreed to repay the
amount after six months.
Cross examination by Adv. Anil More for the accused:
2. I know why I am present today. I have came to depose on behalf of
complainant. I know for what purpose complainant has filed the
complaint. He had made complaint as accused has not returned the
money. It is true to say that complainant is my friend. It is not true to
say that complainant is indulged in money lending business. I was present
at the time of giving Rs.5 lakhs and Rs.1 lakh to accused as complainant
had asked me to remain present. I do not know whether Udya Mohite had
also obtained money from complainant. I can tell from where complainant

brought Rs.5 lakhs. He brought Rs.5 lakhs from Shalan Pawar as hand
loan for six months and gave it to the accused. Shalan Pawar was also
serving in BMC. She is now retired. I know her. She had no business of
lending money. She had given money temporarily as hand loan. That was
interest free hand loan without interest. I can tell denominations of the
currency notes. All amount was of Rs.500 currency notes. Ramesh Yadav
told us that he was working in BEST. It is not true to say that no
transaction taken place in between complainant and accused. It is not
true to say that as the loan amount of Udya Mohite was not recovered,
complainant filed case against Ramesh Yadav. It is not true to say that I
am deposing false. It is not true to say that I am deposing false out of my
friendship with complainant.
