1. Perused the application. Initially Ld. Advocate
representing the complainant was absent. Hence, no arguments order
was passed. Latter on Ld. Advocate is present and argued on the
application. Heard Ld. Advocate of the complainant. Gone through
the proceeding. By moving the instant application the complainant
wants to correct some mistakes appeared in the complaint viz Name
of the complainant, Name of the accused, Name of the Bank, in the
amount mentioned in words in para no.13 and 14. The complainant
also wants to add some contents in para no.4. As per the contention
of the complainant these mistakes are bonafide and not deliberate.
Those mistakes needs to be corrected.
2. Since the case is filed U/sec 138 of the Negotiable
Instruments Act, the correct names of both the party, Bank name and
amount requires to be pleaded . Some mistakes appear to be
tyopographical and some appears to be by faulty pleading. The
verification of the complainant is not yet recorded. No prejudice
would cause to the accused, if the mistakes are corrected. In the
other words, the mistakes needs to be corrected for the proper
adjudication of the dispute between the parties. Hence, the

application deserves to be allowed. Hence the following order.
Order
1. Application is allowed.
2. The complainant to comply the order by correcting the mistakes
in the complaint on or before next date.
3. He is at liberty to file fresh copy of his affidavit of examination in
chief.
