ORDER
1. The application is filed by the applicant for return of Apple watch series 5
seized by Santacruz Police Station CR.No. 435/2022 registered u/sec. 379, 354(d), 509
of IPC.
2. I.O. has given no objection to return the watch to applicant.
3. The applicant submitted that her watch was stolen and she lodged the
report about the incident. IO did not raise any objection for return of the watch.
Applicant has filed bill to show her ownership. There is no rival claim for custody of the
seized watch. The seized watch is not required for further investigation of the crime. No
good purpose would serve keeping the watch in the police custody. It will be proper to
hand over the custody of the watch to the applicant by imposing conditions. Hence,
following order is passed.
ORDER
1) The application is allowed.
2) The custody of Apple watch series 5 seized by Santacruz Police Station CR.No.
435/2022 registered u/sec. 379, 354(d), 509 of IPC be handed over to the
applicant.
3) The applicant to execute indemnity bond of Rs.10,000/.
4) The applicant is directed not to sell, transfer, alter, dispose or hand over the
seized mobile hand set to third person without prior permission of court and to
produce the concerned mobile hand set before the Court, whenever
required for trial.
