Cross examination of CW-01- Mr. Avinash Krishna Kumar Singh by
advocate Mr. K.D.Kothari for the accused :
16. I am double Graduate. I am working as a Pilot in Air India
since June 2005. There are three directors of complainant company. My
father Krishnakumar Singh, mother Manjula Singh and wife Shallu
Singh are the directors. The complainant company formed in the year
2017-2018. I do not know exact date of formation of the complainant
company. Since inception of the company above three persons are the
only directors. My father is about 72 years old. My mother might be of
70 years. It is true to say that I am not looking after the daily work of
the complainant company. It is true to say that I am not holding any
position as an employee in the complainant company. The Registered
Office of the company is now changed since COVID-19 Pandemic
period. We have to sold said flat. It is true to say that on certified copy
of Resolution Exh.21, except my father other directors have not made
their signatures. It is true to say that I have not produced the copy of
minute book. I can produce the minute book in which the Resolution
dated 27.11.2020 is recorded. It is not true to say that other two
directors have not authorized my father to pass the Resolution. It is not
true to say that my father was also not authorized to pass any
Resolution or present the complaint. It is true to say that I have
mentioned in my evidence affidavit that complainant was running

Restaurant and Bar known as House of Party located at Oshiwara,
Andheri. It was on ground floor of Land Mark Building. House of Party
was the Private Limited Company. Complainant company Vaishnavi
Hospitalities Pvt. Ltd. was running the Restaurant under brand name
House of Party. The property of Restaurant and Bar is rented property.
The rent agreement was executed with owner of the property by
complainant company. The Restaurant and bar was started in the year
2018. During COVID-19 Pandemic period we wind up the business after
discussion with accused Company.
17. There was only one bank account in the name of
complainant company maintained with HDFC Bank. There was no bank
account in the of House of Party. It is true to say that there was no
written agreement for selling and purchasing furniture, music system,
sounds lights etc in between me and accused.
On oral request of the advocate for the accused cross
examination is deferred till next date.
