ORDER BELOW EXH.1
1. The petitioner has filed this case for initiating contempt proceedings
against the respondent Nos.2 to 4 i.e. various officers of Indusind Bank Ltd.
U/Sec.2(B) of the Contempt of the Court Act. I have perused the record of
notice case No.324/2024. Admittedly, the respondent Nos.2 to 4 were not
parties to the said proceeding. Therefore, there would be no occasion that they
have knowledge of the order in notice case No.324/2024, unless the same is
communicated to them. According to respondent Nos.2 to 4, before they
received the intimation of this order, by the order of various courts the amount
was debited. Therefore, they have not deliberately or willfully disobeyed the
order of this court. There is nothing on record that the order of this court is
communicated to them prior to the debit of the said amounts in execution of
orders of other courts. Therefore, I found, non execution of order of this court
is not at all willful and deliberate. Hence, contempt proceeding can not be
initiated against respondents. Thus, I proceed to pass the following order :
ORDER
Petition is dismissed.
