ORDER BELOW EXH.1
1. The applicant/accused, in case of National Cyber Crime
Reporting Portal acknowledgment No.31908240110815, has filed this
application to defreeze his current bank account No.50200044908474
HDFC Bank, Branch Rajkot. Perused application, say of I.O. and Ld.
A.P.P. Heard Ld. Advocate for applicant and Ld. A.P.P.
2. According to I.O. the complainant has registered the complaint
at National Cyber Crime Reporting Portal alleging that Rs.74 lakhs has
been debited from his account and thereby he was cheated. Said amount
was transferred in the account of present applicant and said account is
freeze. The amount Rs.71 lakhs credited to the said account is also
freeze. The said freeze amount Rs.71 lakhs is returned to the
complainant as per the order of court. However, Rs.3 lakhs is not yet
traced out. The complainant is not pursuing the said case and currently
he has no interest in this case. The complainant is not appearing in the
police station to register the F.I.R. or to make his claim. After his
appearance the police will proceed further. Therefore, the I.O. has
objection to unfreeze the account of applicant.
3. It appears that the alleged incident happened one year ago.
The applicant’s account is freeze since then. However, neither the F.I.R.
is registered nor complainant is appearing in the police station.
Therefore, without any reason and progress, the account of applicant can
not be kept non-operated. In case his account is not unfreeze, he will not
operate his account and could not do the transaction of his whatever
business. Hence, in such circumstances the account of applicant needs to
be defreezed. Thus, I proceed to pass the following order -
ORDER
a. The application is allowed.

b. The current bank account No.50200044908474 HDFC Bank,
Branch Rajkot account of applicant/accused is defreeze and permitted to
operate subject to condition that the amount Rs.3,00,000/- shall be keep
as lien and put on hold until further order.
