ORDER BELOW EXH.1
1. This is an application under Section 457 of Code of Criminal
Procedure for release of property.
2. As per applicant after incidence of theft at market she
approached police station Bandra and the offence at C.R. No.466 of
2020 was registered for offence punishable under Section 379 of Indian
Penal Code against unknown persons. Later on during investigation
accused were traced and certain recoveries out of the diamond and other
documents stolen from possession of informant were made. She is in
need of the recovered diamond and other documents, therefore this
application. Say of the I.O. and Ld. A.P.P. was called. I. O. has no
objection to handover the said property.
3. Investigation relating to property is over. From the say of
Investigating Officer it is clear that applicant is legal claimant of the
property. Therefore, following order -
ORDER
a. The respondent is directed to handover the property
mentioned in its say to the applicant on her executing indemnity bond of
Rs.1,20,000/- (Rupees One Lacs and Twenty Thousand Only).
b. While accepting custody, the applicant shall furnish the
photograph of the article handed over to her.
