ORDER BELOW EXH.1
1. This is an application under Section 457 of Code of Criminal
Procedure for release of property. As per applicant the cellular phone
mentioned in the application is seized by respondent in connection with an
offence registered with respondent police station at C.R. No.486 of 2021,
for offences punishable U/Sec.379 of Indian Penal Code. The investigating
relating to him is completed. Therefore, he filed present application for
handing over custody of stolen article.
2. Say of the respondent was called. No say filed. The investigating
relating to mobile is completed. If it remained in further custody of
respondent it will definitely damage and hence, order -
ORDER
a. The application is allowed.
b. The respondent is directed to handover the cellular phone mentioned
in the application to the applicant on his furnishing indemnity bond of
Rs.18,000/- each (Rs. Eighteen Thousand Only) before them.
c. The copy of this order be kept in C.R. No.486/2021, registered with
Bandra Police Station, Mumbai.
