ORDER BELOW EXH.1
Read complaint. Perused documents placed on record. Heard
Ld. Advocate for the complainant.
2. According to complainant accused No.1 to No.4 were it’s
employees and they have entrusted with the work of account department
of the company such as maintaining the accounts to collect cash from
customers and same has been deposited in the bank account of the
complainant’s company. However, the accused by joinging hands with each
other have committed fraud and cheated the complainant company to the
tune of I.1,70,00,000/-. It is further contented that, accused No.1and No.2
entered into an agreement with company admitting their responsibility for
the fraud. Thus, according to the complainant accused committed fraud in
the account of the company and cheated.
3. The verification statement (Exh.-4) categorically made out the
ingredents of offence under section 420 of the Indian Penal Code.
Therefore, I hold that, the complainant had made out the
prima-faciely
case. Hence, issue process under section 420 r/w.s. 34 of Indian Penal
Code against accused persons.
The case be registered as Warrant Triable Case.
