ORDER BELOW APPLICATION EXH.14
This is an application moved for recalling or staying order of
Production Warrant issued against accused No.2 by taking matter on
board by the advocate for accused No.2.
2. Advocate for accused Mr. Vikas Sharma submitted that accused
No.2 is lodged in Mumbai Central Jail since 17.12.2022 in connection
to various crimes registered under MPID Act, 1999 by EOW. He has
been granted bail by the Sessions Court and Hon’ble High Court.
Already relase orders are also forwarded to concerned Jail Authority.
However, due to pending Production Warrant ordered against accused
No.2 vide order dated 15.03.2023 passed below Exh.9, Jail Authorities
are not releasing the accused despite granting bail.
3. Advocate for accused has undertaken to keep accused No.2
present for trial. It is surprising that due to pending execution of
Production Warrant, Jail Authorities are curtailing the liberty of the
accused without producing said accused before the concerned Court as
per pending warrant of this Court. Liberty of accused can not be
curtailed if accused is granted bail by the Higher Authorities for the
sake of alleged Production Warrant. Considering the undertaking given
by the advocate of accused, the order of issuance of Production Warrant
of accused No.2 needs to be modified. Hence, I pass following order.
ORDER
1. Order dated 15.03.2023 whereby production of accused No.2
Jagdish Ahuja was ordered stands cancelled.

2. The Production Warrant issued against accused No.2 in
present case be recalled back forthwith unserved.
3. Ld. advocate for the accused to take note that further order of
issuance of Non Bailable Warrant against the accused stands
as it is, for securing his presence.
4. Order dictated and pronounced in open court.
5. Order be uploaded on Court Web Portal.
6. Judicial Clerk to forward this order by e-mail forthwith to
concerned Jail.
