ORDER BELOW EXH.1
1. Perused record. Accused is present and pleaded guilty to the
offences. The consequences pertaining to possible punishment made her
understand. Despite that accused is ready to plead guilty and as such her
plea is voluntary.
2. Heard Ld. A.P.P. and Ld. Advocate for the accused on the point of
sentence. Ld. A.P.P. prayed for severe punishment, however, it is
submitted that accused is a woman of young age, having child dependent
upon her. She is poor and act committed inadvertently. Therefore, she
shall be awarded leniency. The property involved is not much high. There
is substance in the submissions made. It is her first offence. Considering
the status and age of the accused, grounds assigned and nature of property
involved the leniency needs to be shown. The awarding substantive will
cause serious prejudice to her. Accordingly, following order :
ORDER
a. The accused Mrs. Fara Firoz Shaikh, is convicted under Section
241 of the Code of Criminal Procedure, for an offence punishable under
Section 379 of Indian Penal Code and released on admonition that she
shall not commit such act again.
b. Accused shall furnish undertaking to that effect.
c. The property seized shall be handed over to informant.
d. Cash security deposited shall be refunded after appeal period.
e. Copy of this order shall be given free of cost to accused.
