This application is filed by the applicant namely Pravin Ashok
Gupta for release of Cash of Rs.98,000/, which is seized by the Nirmal
Nagar police station in connection with Crime No.187/2023 registered with
the Nirmal Nagar police for the offence punishable under section 420 of
I.P.C. and section 66(c) of I.T. Act.
2) Say was called from I. O. and A.P.P. The I.O. has no objection
for giving Rs.98,000/. The Ld. APP has requested for passing appropriate
order.
3) In support of his contention regarding ownership, applicant has
filed on record xerox copies of FIR, Aadhar card, PAN card, bank statement
alongwith his affidavit. The applicant is praying for return of money, which
is freezed by I.O. and said money is in the account of accused. Furthermore,
I.O. freezed two amounts i.e. 24,80,792/ and 3,61,800/. Therefore, he is
not entitled to get the custody of cash of Rs.98,000/. Under such
circumstances, I pass following order :
