ORDER BELOW BAIL APPLICATION
(IN C. R. NO.459/2025 (Bandra P.S.)
1. Perused record. Heard both the sides.
2. This is an application under Section 480 of Bhartiya Nagarik Suraksha
Sanhita (B.N.S.S.), for bail. Accused prayed for bail mainly on the ground
that he is poor and innocent. Investigation relating to him is over. He is ready
to remain abide by the conditions, if any, imposed, etc. Investigating Officer
has not filed his say. Ld. A.P.P. objected to it stating that investigation is in
progress and there is possibility of tampering.
3. Accused is in custody since 23.03.2025. The contraband is already
recovered. As such investigation relating to accused is over. Offence is triable
by this Court itself. Accused is ready to remain abide by the conditions. He is
resident of place situated within the jurisdiction of this court itself. The
conclusion of investigation, filing of charge-sheet and consequent conclusion
of trial will take much time. Accused is ready to remain abide by the
conditions, if any, imposed. Considering reasons mentioned in the
application, say of the Ld. A.P.P. and above aspects of the matter, following
order.
ORDER
a. Application is allowed.
b. Accused Mr. Mohd. Adil Salim Shaikh @ Tilya, is released on bail on
his furnishing P.B. and S.B. of Rs.15,000/-. Permission granted to deposit
cash surety instead of surety bond.
c. Accused shall furnish his detail address and proofs thereof.
