Perused record. Today the matter is taken before this Court in Special
Drive for petty offences. The offences are triable as summons case. Accused
continuous absent. Despite efforts, presence not secured till date. It can be
inferred from the record that possibility of his appearance in near future is
almost nil. Further, the record shows that allegations are vague and the basic
requirements to prove the charge are missing. The whole final report even if,
accepted as it is no conviction is warranted. Considering all these factual
and legal aspects, there is no point in proceeding further with the present
matter. Therefore, following order :
ORDER
A. The proceeding stopped under Section 258 of Code of Criminal
Procedure and accused discharged.
B. Cash surety, if any, deposited shall be refund to the accused, if
claimed within one year from today.
C. After one year the cash surety amount be forfeited to the Government.
Liberty granted to the accused to claim it even after one year also, by
applying to that effect.
