The complainant and advocate absent since last so many
dates. The case is pending since year 2018. Plea of the accused
recorded on 10.07.2019. The matter is for cross examination of the
complainant, but complainant could not secure presence of the accused.
No steps taken to proceed further with the matter despite passing
specific order dated 29.01.2025. Keeping the file pending years
together without proceeding further taking appropriate steps by the
complainant is unjustified.
2. Considering the year of the case there is reason to believe that
complainant might have lost interest in proceeding with the case.
Hence, I pass following order.
ORDER
1. Complaint is dismissed in default of the complainant vide
section 256 of Cr.P.C.
2. Accused is acquitted of the offence punishable under section
138 of Negotiable Instrument Act.
3. Order dictated and pronounced in open court.
