Cross examination of CW-01- Surendra Jibodh Tiwari by accused in person :
20. I was not knowing you accused prior to year 2019. I came to
you only in the year 2019 when you met me at Bharat Co-operative bank. I
will examine Ratnakar Salian and Dinesh Amin for proving that you were
introduced by them to me. I have not produced any document to show that
you accused have obtained loan from bank and bank has seized your flat. I
have produced letter given by you in bank to show that you have demanded
money to me. I have obtained cheque from you as a security of loan. I have
filed Income Tax Returns for Assessment year 2019 through my Chartered
Accountant Mr. Pujari. I have shown the loan amount of Rs.5 lakhs in my
Income Tax Returns. I will produced the copy of ITR of year 2019 certified by
my Chartered Accountant. I have given you Rs.4,65,000/- by cheque and
Rs.35,000/- by cash. You yourself has given me receipt. You have issued the
receipt in presence of Ratnakar Salian, Dinesh Amin and Harinaksh Poojari to
me. I have not produced acknowledgment card of Registered post envelop
wherein demand notice was sent to you. You gave cheque of Rs.5 lakhs to me
at Bharat Co-operative bank, Kalina branch. I do not remember exact date of
issuing cheque but it was issued in the year 2019. I am customer of Bharat
Co-operative Bank. I am not aware that said account of you accused is seized
by Income Tax Department.
