ORDER BELOW APPLICATION FOR RETURN OF PROPERTY IN
C.C.NO.320/N/2022 OF BKC POLICE STATION.
1. The applicant Abhuday Pratap Singh filed this application
for return of 1) two Indian passports i) passport bearing no. V7993430
ii)Passport bearing no. V0367490 2) Indian CDC bearing no.
MUM360369 3) Three experience certificate from Doris Ship
Management 4) One experience certificate from Gulper Eel
Management 5) One experience certificate from Sea Expert Marine
Services 6) One experience certificate from Allianz Middle East Ship
Management 7) One experience certificate from Houston Marine
Services 8) One medical record file from John Stroger Hospital, USA 9)
One Samoa Government issued Captain COC40392 10) One Samoa
Government issued GMDSS License 11) One Belize Government issued
CDC 12) One experience certificate from DPS Marine Tech Solutions
13) One Samoa Government issued Captain CDC.(herein after referred
as seized documents) seized by BKC Police station in CR No. 164/2022
registered u/sec. 420, 465, 467, 468, 471, 120B of IPC.
2. Respondent and APP opposed the application.
3. Admittedly the seized documents are not used for the
commission of the alleged offence. The seized documents are not the
offending documents. IO has not applied to the passport authority for
taking any action. Seized documents are not required for investigation.
Keeping the seized documents in custody of the police station for
further period are not necessary. Thus, it will be proper to return the
same to the applicant. Applicant is ready to abide by the conditions that
may be imposed on him. In the result, following order is passed:

1. The application is allowed.
2. The custody of 1) two Indian passports i) passport bearing no.
V7993430 ii)Passport bearing no. V0367490 2) Indian CDC
bearing no. MUM360369 3) Three experience certificate from
Doris Ship Management 4) One experience certificate from
Gulper Eel Management 5) One experience certificate from Sea
Expert Marine Services 6) One experience certificate from Allianz
Middle East Ship Management 7) One experience certificate from
Houston Marine Services 8) One medical record file from John
Stroger Hospital, USA 9) One Samoa Government issued Captain

Government issued Captain CDC.(herein after referred as seized
documents) seized by BKC Police station in CR No. 164/2022
registered u/sec. 420, 465, 467, 468, 471, 120B of IPC , be
handed over to the applicant.
3. The applicant is directed to produce the said documents as and
when required by this court.
4. The applicant should obtain prior permission of this court before
traveling abroad.
