ORDER
1. The applicant is praying for return of amount of Rs. 9,99,000/
lying in bank account of Prime Overseas with Indusind Bank at Gugaon in
connection with CR No. 78/2021 registered with Vakola Police Station, u/sec.
420, 34 of IPC and 66C, 66D of Information Technology Act.
2. Heard.
3. The say I.O. shows that the amount is traced out to the bank
account of Prime Oversease with Indusind Bank. However, the said account has
been already freezed. It also appears that police station Bangalore, Cyber Police
Station Vijaywada, Cyber Crime Branch Mumbai, Cyber Crime Branch Pune and
Cyber Crime Branch Pune City have applied to the said bank to freez the said
account. It appears that several persons like the applicant have been cheated and
they have become victims of fraudulent activity. The amount lying in the bank
account of Prime Oversease is freezed on the request of many other police
authorities. The victims of all these criminal activities are having claim in respect
of the amount in the said account. Thus, it is difficult to decide the entitlement
of the applicant at this stage. The investigation in this case is in progress. It is
not clear as to how many claimants are there in respect of the amount lying in
the said account. Therefore, it will not be proper to release the amount in favour
of the applicant at this stage. Hence, the application is rejected.
