ORDER BELOW BAIL APPLICATION
IN C. R. NO.1827/2024 (Bandra P.S.)
1. Perused record. Heard both the sides. Heard Ld. Advocate Shri. Ojas
Gole, for the informant.
2. Though matter is serious and somewhat huge amount involved, the
present application is filed in shabby manner praying for bail on the basis of
single line grounds pleaded contending that allegations are false and applicant
is innocent, by filing certain particulars in already blank photocopied format.
It is also shabbily mentioned that accused is ready to pay the amount. Ld.
A.P.P. objected to it stating that offence is serious, investigation is incomplete
and therefore, application shall be rejected.
3. In the above background facts there remained no option, but to reject
the prayer for bail. However, it is submitted that accused has already paid
Rs.5,00,000/- to the informant and also ready to pay the remaining amount in
installments, as per schedule mentioned in separate pursis filed now. The Ld.
Advocate for the informant admitted this fact of payment. He also filed his
say and submitted that informant has no objection to grant bail in view of
amount paid and undertaking furnished. He also submitted that the conditions
to that effect may be imposed.
4. Further, it is also noticed that offence is quite old and matter seems to
be amicably settled. Investigation seems to be over and possibility of
tampering is almost nil. The applicant is of tender age and businessman.
Keeping the accused in detention may not serve the interest of justice. Ld.
A.P.P. also fairly conceded that if conditions imposed, bail may be granted.
5. Considering peculiar facts and circumstances came on record and no
objection given by informant, bail needs to be granted. Rejecting the bail for

want of proper pleadings of grounds may have an effect of following hyper
technical approach. Accordingly, following order -
ORDER
a. Application is allowed.
b. Accused Mr. Sarthak Sanjay Das, is released on bail on his furnishing
P.B. and S.B. of Rs.15,000/-, and subject to condition that he shall repay the
amount as per schedule mentioned in pursis, Exh.2, filed herewith.
c. Permission granted to deposit cash security instead of surety bond.
d. Accused person shall furnish his detail address and proof thereof.
