The complainant and advocate absent. Advocate for accused
present. Plea of accused was recorded on 28.11.2022. No steps taken
to file evidence by the complainant. No adjournment application filed
on behalf of the complainant. Perusal of photo copy of Loan Form
dated 21.03.2020, indicates a illegal money lending transaction in
between parties which is not covered within the ambit of section 138 of
the Negotiable Instrument Act. Keeping the file pending years together
without proceeding further, taking appropriate steps by the
complainant is unjustified. Accused has right of speedy trial.
2. There is reason to believe that complainant might have lost
interest in proceeding with the case. Hence, I pass following order.
ORDER
1. Complaint is dismissed in default of the complainant vide
section 256 of Cr.P.C.
2. Accused is acquitted of the offence punishable under section
138 of Negotiable Instrument Act.
3. Order dictated and pronounced in open court.
