ORDER BELOW EXH.1
1. Perused record. The parents of the applicant repeatedly appeared
and sought compliance of directions, issued in High Court order, passed
in Criminal Application No.135 of 2023.
2. Applicant or other side neither appeared nor filed any affidavit
about the above order. Further, formal writ not received by this court till
date. Repeatedly it is brought to notice of the parents of the applicant that
in absence of these facts or receiving of writ from High Court,
compliance can not be done.
3. Then applicant mailed this order to Hon’ble C.M.M., along with
request to pass order. The said mail was forwarded to this court. It is
however, not clarified in the letter sent with this mail whether order can
be passed relying on the submissions of parents of the applicant and
photocopy produced by them without receiving of any writ from the High
Court. Therefore, no order can be passed.
4. Therefore, order -
ORDER
a. Matter is kept on 20.02.2024, awaiting arrival of formal writ letter
from High Court and consequent urgent compliance.
b. Any of the parties are at liberty to file affidavit to that effect so that
writ compliance can be done by passing order as directed by High Court.
