1. The accused present with advocate. He filed pursis, and pleaded guilty to
the offence.
2. The accused made aware of consequences of pleading guilty to the
offence. Despite that he is ready to plead guilty. As such his plea is voluntary.
3. Heard both the sides on the point of sentence. It is submitted by Ld.
A.P.P. that severe punishment be awarded. Ld. Advocate for the accused
submitted that accused is very poor. There are dependents on him. If
substantive sentence is awarded, accused will suffer irreparable loss. Accused
prayed for leniency.
4. The value of stake involved is not much high. It is already seized and
can be returned to the informant, if not yet returned. There appears substance in
the contention of the Ld. Advocate for the accused. The plea of leniency
deserves due consideration. Considering the nature of offence, the property
involved and status of the accused, following order :
ORDER
A. Accused is convicted under Section 241 of the Code of Criminal
Procedure, for an offence punishable under Section 379 of Indian Penal Code
and is sentenced to suffer Simple Imprisonment till rising of Court.
B. The property seized shall be handed over to the informant/victim, if not
yet returned.
C. Copy of this order to be given free of cost to the accused.
