ORDER BELOW APPLICATION EXH.44
This is an application for permanent exemption from personal
appearance of the accused moved on behalf of accused in his absence
with his signature on the application.
2. Said application is strongly objected by the advocate for
complainant.
3. Heard both sides.
4. As the result of Revision Application is awaiting, it would not be
just and proper to decide present application. From the record and
proceeding, it is crystal clear that accused neither remaining present
nor keeping his advocate present for conducting trial. Now trial is at a
stage of recording statement of the accused under section 313 of Code
of Criminal Procedure. At this fag end of the trial presence of the
accused would be required. Even though considering Revision
Application preferred by the accused, present application needs to be
kept in abeyance till next date. Hence, I pass following order.
ORDER
1) Application for permanent exemption to the accused is
kept in abeyance till next date.
2) Order dictated and pronounced in open court.
3) Order be uploaded on Court Web Portal.
