ORDER BELOW APPLICATION EXH.43
This is an application for exemption of accused and adjournment.
2. Advocate for complainant strongly objected the application on
the ground of deliberate delay tactics.
3. Heard both sides.
4. Ld. Advocate for complainant has drawn my attention towards
application which is signed by the accused even though presented by
advocate in his absence. All the reasons mentioned for absence of
accused appears baseless. The same seems to be taken only for
gathering sympathy and to protract the litigation. Medical papers
produced by the accused do not support the contention of accused. The
same are not useful to accept the inability of the accused to remain
present for trial. However, as application Exh.42 moved by the
complainant is kept in abeyance, I pass following order.
ORDER
1) Exemption for today granted as a last chance.
2) Advocate for accused to co-operate the Court to finish
the trial within mandatory period.
3) Order dictated and pronounced in open court.
4) Order be uploaded on Court Web Portal.
